Kansas City man receives over three years in prison for illegal machinegun transfers

A Kansas City, Missouri man has been sentenced in federal court for crimes involving machineguns and machine gun conversion devices known as “switches.” Davorian M. Fleming, 21, received a 37-month prison sentence from U.S. District Judge Beth Phillips on September 9, 2025.

Fleming pleaded guilty earlier this year to charges of possession and transfer of machineguns. He admitted that the switches were considered machineguns under federal law and acknowledged assisting co-defendants in transferring these devices.

One of Fleming’s co-defendants, K’Orion A. Duff, also from Kansas City, was previously sentenced to 15 months in prison for distributing machine gun conversion devices. Two other co-defendants are awaiting sentencing.

Federal law prohibits the possession or transfer of a machinegun as defined by Title 26, United States Code, Section 5845(b). This includes devices like switches that convert semi-automatic firearms into fully automatic weapons.

Assistant U.S. Attorney Ashleigh Ragner prosecuted the case following an investigation by the Bureau of Alcohol, Tobacco, Firearms, and Explosives.

The prosecution is part of Operation Take Back America. According to the press release: “This case is part of Operation Take Back America, a nationwide initiative that marshals the full resources of the Department of Justice to repel the invasion of illegal immigration, achieve the total elimination of cartels and transnational criminal organizations (TCOs), and protect our communities from the perpetrators of violent crime. Operation Take Back America streamlines efforts and resources from the Department’s Organized Crime Drug Enforcement Task Forces (OCDETFs) and Project Safe Neighborhood (PSN).”
